The High Court Criminal Division has heard testimony from Chief State Attorney Joseph Kyomuhendo as the State moves to conceal the identities of six key witnesses in the treason case involving opposition politician Dr. Kizza Besigye, Obeid Lutale, and Captain Denis Oola.
The matter was heard before Justice Emmanuel Baguma, where Kyomuhendo defended an application by the Office of the Director of Public Prosecutions seeking witness protection on grounds of safety and security.
Kyomuhendo told court that revealing the identities of the witnesses at this stage could expose them and their families to risk, arguing that treason is a high-risk and organised offence with potential for retaliation.
“The State does not need to wait for actual harm before taking protective measures,” he said, adding that even accused persons in custody can still pose a potential threat to prosecution witnesses.
He also indicated that he had previously faced threats while handling cases involving Dr. Besigye.
During cross-examination, Kyomuhendo initially told court he would appear as a witness of fact but later indicated he would also address legal issues where necessary, prompting a tense exchange with defence lawyers led by Fredrick Mpanga, Ernest Kalibala, and Erias Lukwago.
Meanwhile, Dr. Besigye marked his 70th birthday while still under detention in connection with the charges, with supporters, family members, and associates sending messages of solidarity and singing birthday songs in his honour.
Despite the circumstances, the gesture reportedly drew a brief smile from the opposition figure.
The case has now been adjourned to May 6 and May 10, 2026, for continuation of the cross-examination of the State Attorney.
